090821 SM's Side of the Lawsuit

According to South Korean media, it is reported that at the Seoul Central Court, at 10:20 a.m., a session of the JaeSuYoo lawsuit took place.

SME's lawyer had stated in court that SM never forced TVXQ to star in ads or unwillingly made them perform and had always timely paid DBSK the income they deserved. SM had said in court, that because of this dispute, they had suffered from 150 billion won in direct economic losses and had made a serious blow to the company's image. So, SME hopes to resolve the dispute as soon as possible.

SME's lawyer had said that SM had wanted to stop them from promoting the cosmetic company because they were mainly worried about DBSK's image, not other goals.

The problem about DBSK belonging to SM for an excessive amount of time was talked about. SM's lawyer had said that the Korean Fair Trade Commission had recently released a respective agreement about the companies owning singers for an unlimited amount of time.

SM's lawyer had also stated that they would, every six months, have an income distribution reciept issued to the DBSK members and allowed them to sign to confirm.

SME and JaeSuYoo, though both sides were against each other in the morning, they both indicated that they did NOT want DBSK to disolve/disband.

The previous day, there had been about an estimated amount of 120 000 TVXQ fans that were also signing a petition to the court and asking for agreements to DBSK's favours.

090821 TVXQ's 3 Members Side, "Without Revealing The Entire Contract, It Will Be Hard To Reach An Agreement"

TVXQ's three members' legal representative stated that, "Without revealing the entire contract as well as all the income TVXQ has earned, it will be hard to reach a mutual agreement."

Judge Park Byungdae of Seoul District Courts was in charge of the first hearing between SM Entertainment and the three members of TVXQ. On that day, he revealed that he wished for the two sides to come to a mutual agreement for sake of the world's biggest fanclub and the other two members.

In accordance to this, Sejong, who is representing the three members of TVXQ, stated, "Unless SM Entertainment reveals the entire contract as well as TVXQ's income, it will be hard to reach an agreement."

Also, Sejong said, "Xiah Junsu states that SME's claim that he took 45 million Won in advanced payment is completely false."

TVXQ's three members, who are currently in a dispute with SM Entertainment (SME) over the period of their exclusive contract and the income division, have stated that the cosmetic company is not the focus of this trial.

The first hearing of the lawsuit between the three members of TVXQ, YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, and their agency SM Entertainment began at 10:20 am on the 21st.

At this hearing, the three members' lawyer explained their unlawful exclusive contract in reference to the contract period and the unfair income division. But the lawyer did not talk of the cosmetic company that SME stated was the real reason behind this lawsuit.

090821 SM "We've Lost 15 Billion Won+ In Image Damage Because Of This Trial"

SM Entertainment (SME) stated that they were the only ones who received damages because of the request for the suspension of TVXQ's exclusive contract.

On the 21st at 10:20 am, the first hearing for the lawsuit between SM Entertainment and the three members of TVXQ's Youngwoong Jaejoon, Micky Yoochun and Xiah Junsu, began.

During this hearing, SME's lawyer stated, "In the case of the three members of TVXQ, they don't have any dissatisfied feelings towards this lawsuit as it got them out of concerts and advertisements that they did not want to participate in," and "But in the case of SME, they had to pay compensation for said canceled events and future scheduled events with 8 billion Won to pay domestically and 15 billion Won to pay if overseas activities are calculated. Not only will SME suffer monetary loss, the image of SME has also been hit because of this trial."

SME's lawyer stated that the focus of this lawsuit was not the period of the exclusive contract or the unfair income division, but the cosmetic company that the three members were involved with. He explained that the only two reasons SME asked the three members not to participate in such a venture were because such a venture went against their exclusive contract and because the venture could hit TVXQ's image in a negative way.

SME's lawyer also said, "In reference to the length of their exclusive contract, the special quality of the entertainment business needs to be considered," and "Even in the recommended exclusive contract guidelines released recently, there are exceptions when it comes to singers."

He also said, "The three members claim that they never were told of exactly how much they earned but SME revealed this amount to the members every six months and the members even signed these income documents."

On a side note, the three members of TVXQ filed for an Exclusive Contract Validity Suspension and Provisional Disposition Request against their agency SM Entertainment on July 31st. They also filed for a Preservation of Evidence request to be able to calculate the exact amount of TVXQ's income.

The three members asked for a cancellation of their contract due to the unlawful clauses in said contract but SM Entertainment stated that the three members were filing this lawsuit because of the cosmetic company they were associated with; both sides show no signs of backing down. TVXQ's leader U-Know Yunho and youngest leader Choikang Changmin did not participate in this lawsuit.

090821 Courts Urge For A 'Mutual Agreement' For The TVXQ Dispute

Popular group TVXQ's three members asked for a suspension of their exclusive contract against SM Entertainment and the first hearing occurred on the 21st.

Seoul District Court's Judge Park Byungdae, after listening to both sides, said, "We think the best way to solve this dispute is for the two sides come to a mutual agreement, when we put the responsibility for biggest fan club in the world and the relationship with the other two members into consideration."

The judge stated, "If both side would like to set a settlement date that will not be open to the public, that can be arranged," and urged both sides to come to a mutual agreement.

The Courts agreed to both sides' wishes of ending this dispute early on and will come to a decision after examining all the related materials handed in on September 11th which is 3 weeks after this first hearing.

The lawyer representing the three members said, "They do not want a disbandment of TVXQ," and "There are cases where teams stay together even if the members are in different agencies."

Also, when the Courts asked whether they wanted a 'cancellation of their contract' or a 'revision of their contract', the lawyer replied, "It depends on how competent SM Entertainment will be to support TVXQ's transition from an idol group to a more mature artist group," and "The opportunities are endless."

SM Entertainment's lawyer said, "Although the three members who filed this lawsuit are not having their right violated, the agency is losing a lot of money due to this trial so we wish for it to end quickly and for TVXQ to start their activities again," and "The only reason SME asked the three members to not participate in the Chinese cosmetic company branch was because the agency feared that TVXQ's image might be damaged in some way; the agency had no other intentions."

The Courts said, "As long as this lawsuit has been filed, please refrain from talking about or attack the other side through the media."

TVXQ's three out of five members, Xiah Junsu (Kim Junsu), YoungWoong Jaejoong, (Kim Jaejoong) and Micky Yoochun (Park Yoochun), stated that "Our 13 year exclusive contract can basically be seen as a life contract, and we did not receive proper treatment from SME in many aspects such as income division," and filed their lawsuit on July 31st.

090821 SME Complains About The Preservation Of Evidence Reques

SM Entertainment filed an appeal regarding the preservation of evidence request the three members of TVXQ filed recently.

SME's side filed for their appeal at the first hearing that began on the 21st at 10:20am.

SME's side stated, "Some of the receipts and other documentation used to calculate TVXQ's income are the company's secret information. Therefore, it could be fatal to SME if these forms of documentation were revealed to the media."

The Courts explained a 'In Camera' system that they use which will invalidate SME's claims. The 'In Camera' system is a system in which only a few select people are able to see the important files or the business' secrets in an enclosed area.

This appeal makes people question how accurately the Courts will be able to calculate the actual income of TVXQ.

090819 U-Know Yunho Says "I Feel Good About Our First Filming For The Drama"

TVXQ member U-Know Yunho, who will be acting under his real name Jung Yunho, shared his feelings about his first drama shoot.

Jung Yunho immersed himself in filming for MBC's new Wednesday-Thursday drama 'Heading to the Ground' where he plays the role of Cha Bong-goon, a man who has nothing except a goal and passion.

On July 28th, Jung Yunho began filming for the first episode at Gangnam Sangsoo-dong by acting as Cha Bong-goon talking with his neighborhood, long-time friend Oh Yeoni (Lee Yoonji). Jung Yunho checked and refined each and every one of his actions and lines and practiced his lines every chance he had. He showed his passion eagerness for his role by asking the staff whether his interpretation of the character was fitting.

Bong-goon is a character who has a playful and ever-changing personality. During this particular filming, Bong-goon's character required many facial expressions such as suddenly smiling for no reason or scrunching one's face up in anger. Jung Yunho, who acted out each expression naturally, said, "Bong-goong's character has the best personality," and asked the staff questions such as, "Was my scene funny? Did it come out well?" and showed his satisfaction for a successful first shoot that ended in a comfortable and fun atmosphere.

Jung Yunho, who said he had to work out very hard for his role, said, "I'm having so much fun playing the character of Cha Bong-goon I feel good about the first filming for our drama."

'Heading to the Ground' is a love story that results from the misunderstandings that arise between passionate yet unlucky Bong-goon and Kang Haebin (played by Ara), a girl who has everything but wishes to succeed on her own. It is also a Humanism drama that touches upon Cha Bong-goon's will to live even though he had lived through three near-death experiences. The first episode airs on September 9th.

"Protect the star." 

In some drama filming locations these days, there is something of more important than finishing a high-quality scenes. It is the 'Star Protection' of the lead roles.

From top stars who are making a comeback to dramas from movies to popular idol group members, most of these stars are taking on lead roles in dramas and every time they go outside to film, the streets end up being clogged up with fans and neighborhood people hoping to catch a glimpse of their favorite stars.

The reason staff are so focused on protecting the stars is because the fans who come to the locations do more than come to support their favorite celebrity. The fans come as many as 200 at a time and not only does this interfere with filming, it also affects the other actors there as well.

The filming crew with the biggest problem regarding fans who visit the filming location is crew of MBC's new Wednesday-Thursday drama 'Heading to the Ground' that stars popular idol group TVXQ's member U-Know Yunho.

As three members of TVXQ are having a dispute over their exclusive contract with their agency, fans come on location to support TVXQ as well as to see U-Know Yunho's transformation from a singer to an actor.

One representative of 'Heading to the Ground' said, "The fans are interfering the filming process by screaming and shouting out loud every time U-Know Yunho does even the smallest action on location. We're filming small scenes for a couple of episodes but our first episode airs on September 9th and we still haven't completed filming the entire first episode." He also said, "There's the problem with the lawsuit, and we heard that the fans are usually very passionate, so we are protecting U-Know Yunho with one manager and one bodyguard constantly at his side," and also pleaded to the fans by saying, "Please help U-Know Yunho and all the other actors concentrate on their scenes."

The same goes for KBS 2TV's Wednesday-Thursday drama 'Iris' that stars Lee Byunghun and Kim Taehui. Since there are these two famous 'Hallyu Stars', as well as popular idol group Big Bang's TOP, there are always lots of fans on location. The main filming location for this drama is an arts centre in Seoul Songpa-goo Moonjung-dong. A rumor that 'If you go there, you can see Lee Byunghun and Kim Taehui' has already spread and has resulted in countless fans and neighborhood people visiting the building.

On representative said, "To give the stars presents and to get a glimpse of the stars' faces, we have at least 50 fans who visit a day. We cannot stop them from coming to give their support, but we would like it if they could cooperate and let the actors do their jobs," and "Also, we've closed off the entrances to the building but fans swarm around the entrance where cars go in and out and we fear there might be an accident soon if fans aren't careful."

This was also the case during the hit drama 'Boys Before Flowers' early this year. Since the 'F4' members, Lee Minho, Kim Hyunjoong, Kim Bum, and Kim Jun, received explosive popularity, the staff had a hard time dealing with fans who visited on location. They were only able to finish filming by using guerrilla tactics such as changing scenes that were supposed to be filmed outdoors to scenes filmed indoors or taking the least amount of people needed and secretly and quickly finishing scenes

DBSK gets 3rd golden album from Japan Record Association

Japan Record Association recently announced, “Million single, album selling and acknowledge”. Dong Bang Shin Ki has been acknowledged for a golden disk by selling more than 100K copies of their albums ‘Five In Black’ in March, ‘Stand By You’ in July and ‘3rd LIVE TOUR 2008 -T-’ in August.
