090821 SM's Side of the Lawsuit

According to South Korean media, it is reported that at the Seoul Central Court, at 10:20 a.m., a session of the JaeSuYoo lawsuit took place.

SME's lawyer had stated in court that SM never forced TVXQ to star in ads or unwillingly made them perform and had always timely paid DBSK the income they deserved. SM had said in court, that because of this dispute, they had suffered from 150 billion won in direct economic losses and had made a serious blow to the company's image. So, SME hopes to resolve the dispute as soon as possible.

SME's lawyer had said that SM had wanted to stop them from promoting the cosmetic company because they were mainly worried about DBSK's image, not other goals.

The problem about DBSK belonging to SM for an excessive amount of time was talked about. SM's lawyer had said that the Korean Fair Trade Commission had recently released a respective agreement about the companies owning singers for an unlimited amount of time.

SM's lawyer had also stated that they would, every six months, have an income distribution reciept issued to the DBSK members and allowed them to sign to confirm.

SME and JaeSuYoo, though both sides were against each other in the morning, they both indicated that they did NOT want DBSK to disolve/disband.

The previous day, there had been about an estimated amount of 120 000 TVXQ fans that were also signing a petition to the court and asking for agreements to DBSK's favours.

SM Entertainment (SME) stated that they were the only ones who received damages because of the request for the suspension of TVXQ's exclusive contract.

On the 21st at 10:20 am, the first hearing for the lawsuit between SM Entertainment and the three members of TVXQ's Youngwoong Jaejoon, Micky Yoochun and Xiah Junsu, began.

During this hearing, SME's lawyer stated, "In the case of the three members of TVXQ, they don't have any dissatisfied feelings towards this lawsuit as it got them out of concerts and advertisements that they did not want to participate in," and "But in the case of SME, they had to pay compensation for said canceled events and future scheduled events with 8 billion Won to pay domestically and 15 billion Won to pay if overseas activities are calculated. Not only will SME suffer monetary loss, the image of SME has also been hit because of this trial."

SME's lawyer stated that the focus of this lawsuit was not the period of the exclusive contract or the unfair income division, but the cosmetic company that the three members were involved with. He explained that the only two reasons SME asked the three members not to participate in such a venture were because such a venture went against their exclusive contract and because the venture could hit TVXQ's image in a negative way.

SME's lawyer also said, "In reference to the length of their exclusive contract, the special quality of the entertainment business needs to be considered," and "Even in the recommended exclusive contract guidelines released recently, there are exceptions when it comes to singers."

He also said, "The three members claim that they never were told of exactly how much they earned but SME revealed this amount to the members every six months and the members even signed these income documents."

On a side note, the three members of TVXQ filed for an Exclusive Contract Validity Suspension and Provisional Disposition Request against their agency SM Entertainment on July 31st. They also filed for a Preservation of Evidence request to be able to calculate the exact amount of TVXQ's income.

The three members asked for a cancellation of their contract due to the unlawful clauses in said contract but SM Entertainment stated that the three members were filing this lawsuit because of the cosmetic company they were associated with; both sides show no signs of backing down. TVXQ's leader U-Know Yunho and youngest leader Choikang Changmin did not participate in this lawsuit.

090821 Courts Urge For A 'Mutual Agreement' For The TVXQ Dispute

Popular group TVXQ's three members asked for a suspension of their exclusive contract against SM Entertainment and the first hearing occurred on the 21st.

Seoul District Court's Judge Park Byungdae, after listening to both sides, said, "We think the best way to solve this dispute is for the two sides come to a mutual agreement, when we put the responsibility for biggest fan club in the world and the relationship with the other two members into consideration."

The judge stated, "If both side would like to set a settlement date that will not be open to the public, that can be arranged," and urged both sides to come to a mutual agreement.

The Courts agreed to both sides' wishes of ending this dispute early on and will come to a decision after examining all the related materials handed in on September 11th which is 3 weeks after this first hearing.

The lawyer representing the three members said, "They do not want a disbandment of TVXQ," and "There are cases where teams stay together even if the members are in different agencies."

Also, when the Courts asked whether they wanted a 'cancellation of their contract' or a 'revision of their contract', the lawyer replied, "It depends on how competent SM Entertainment will be to support TVXQ's transition from an idol group to a more mature artist group," and "The opportunities are endless."

SM Entertainment's lawyer said, "Although the three members who filed this lawsuit are not having their right violated, the agency is losing a lot of money due to this trial so we wish for it to end quickly and for TVXQ to start their activities again," and "The only reason SME asked the three members to not participate in the Chinese cosmetic company branch was because the agency feared that TVXQ's image might be damaged in some way; the agency had no other intentions."

The Courts said, "As long as this lawsuit has been filed, please refrain from talking about or attack the other side through the media."

TVXQ's three out of five members, Xiah Junsu (Kim Junsu), YoungWoong Jaejoong, (Kim Jaejoong) and Micky Yoochun (Park Yoochun), stated that "Our 13 year exclusive contract can basically be seen as a life contract, and we did not receive proper treatment from SME in many aspects such as income division," and filed their lawsuit on July 31st.

SM Entertainment filed an appeal regarding the preservation of evidence request the three members of TVXQ filed recently.

SME's side filed for their appeal at the first hearing that began on the 21st at 10:20am.

SME's side stated, "Some of the receipts and other documentation used to calculate TVXQ's income are the company's secret information. Therefore, it could be fatal to SME if these forms of documentation were revealed to the media."

The Courts explained a 'In Camera' system that they use which will invalidate SME's claims. The 'In Camera' system is a system in which only a few select people are able to see the important files or the business' secrets in an enclosed area.

TVXQ member U-Know Yunho, who will be acting under his real name Jung Yunho, shared his feelings about his first drama shoot.

Jung Yunho immersed himself in filming for MBC's new Wednesday-Thursday drama 'Heading to the Ground' where he plays the role of Cha Bong-goon, a man who has nothing except a goal and passion.

On July 28th, Jung Yunho began filming for the first episode at Gangnam Sangsoo-dong by acting as Cha Bong-goon talking with his neighborhood, long-time friend Oh Yeoni (Lee Yoonji). Jung Yunho checked and refined each and every one of his actions and lines and practiced his lines every chance he had. He showed his passion eagerness for his role by asking the staff whether his interpretation of the character was fitting.

Bong-goon is a character who has a playful and ever-changing personality. During this particular filming, Bong-goon's character required many facial expressions such as suddenly smiling for no reason or scrunching one's face up in anger. Jung Yunho, who acted out each expression naturally, said, "Bong-goong's character has the best personality," and asked the staff questions such as, "Was my scene funny? Did it come out well?" and showed his satisfaction for a successful first shoot that ended in a comfortable and fun atmosphere.

Jung Yunho, who said he had to work out very hard for his role, said, "I'm having so much fun playing the character of Cha Bong-goon I feel good about the first filming for our drama."

'Heading to the Ground' is a love story that results from the misunderstandings that arise between passionate yet unlucky Bong-goon and Kang Haebin (played by Ara), a girl who has everything but wishes to succeed on her own. It is also a Humanism drama that touches upon Cha Bong-goon's will to live even though he had lived through three near-death experiences. The first episode airs on September 9th.

In some drama filming locations these days, there is something of more important than finishing a high-quality scenes. It is the 'Star Protection' of the lead roles.

From top stars who are making a comeback to dramas from movies to popular idol group members, most of these stars are taking on lead roles in dramas and every time they go outside to film, the streets end up being clogged up with fans and neighborhood people hoping to catch a glimpse of their favorite stars.

The reason staff are so focused on protecting the stars is because the fans who come to the locations do more than come to support their favorite celebrity. The fans come as many as 200 at a time and not only does this interfere with filming, it also affects the other actors there as well.

The filming crew with the biggest problem regarding fans who visit the filming location is crew of MBC's new Wednesday-Thursday drama 'Heading to the Ground' that stars popular idol group TVXQ's member U-Know Yunho.

As three members of TVXQ are having a dispute over their exclusive contract with their agency, fans come on location to support TVXQ as well as to see U-Know Yunho's transformation from a singer to an actor.

One representative of 'Heading to the Ground' said, "The fans are interfering the filming process by screaming and shouting out loud every time U-Know Yunho does even the smallest action on location. We're filming small scenes for a couple of episodes but our first episode airs on September 9th and we still haven't completed filming the entire first episode." He also said, "There's the problem with the lawsuit, and we heard that the fans are usually very passionate, so we are protecting U-Know Yunho with one manager and one bodyguard constantly at his side," and also pleaded to the fans by saying, "Please help U-Know Yunho and all the other actors concentrate on their scenes."

The same goes for KBS 2TV's Wednesday-Thursday drama 'Iris' that stars Lee Byunghun and Kim Taehui. Since there are these two famous 'Hallyu Stars', as well as popular idol group Big Bang's TOP, there are always lots of fans on location. The main filming location for this drama is an arts centre in Seoul Songpa-goo Moonjung-dong. A rumor that 'If you go there, you can see Lee Byunghun and Kim Taehui' has already spread and has resulted in countless fans and neighborhood people visiting the building.

On representative said, "To give the stars presents and to get a glimpse of the stars' faces, we have at least 50 fans who visit a day. We cannot stop them from coming to give their support, but we would like it if they could cooperate and let the actors do their jobs," and "Also, we've closed off the entrances to the building but fans swarm around the entrance where cars go in and out and we fear there might be an accident soon if fans aren't careful."

This was also the case during the hit drama 'Boys Before Flowers' early this year. Since the 'F4' members, Lee Minho, Kim Hyunjoong, Kim Bum, and Kim Jun, received explosive popularity, the staff had a hard time dealing with fans who visited on location. They were only able to finish filming by using guerrilla tactics such as changing scenes that were supposed to be filmed outdoors to scenes filmed indoors or taking the least amount of people needed and secretly and quickly finishing scenes

DBSK gets 3rd golden album from Japan Record Association

Japan Record Association recently announced, “Million single, album selling and acknowledge”. Dong Bang Shin Ki has been acknowledged for a golden disk by selling more than 100K copies of their albums ‘Five In Black’ in March, ‘Stand By You’ in July and ‘3rd LIVE TOUR 2008 -T-’ in August.

DBSK Fancafe’s Prosecution Application Demanding Compensation

On last August 14th, DBSK fancafe submitted a prosecution application to Korea Consumer Protection Board with subject ‘The postpone of SMTOWN LIVE ‘09′.

The fancafe explained their background of accusation, “They acted unilaterally in postponing the concert, without consideration and fooling all the consumers who had already bought the concert tickets. Thus, we submitted this application.”

In the statement which DBSK fancafe submitted to Korea Consumer Protection Board, they mentioned, “SMTOWN LIVE ‘09 which is scheduled to be held on August 16th is indefinitely postponed.

The postpone was announced a week ago (August 7th) with the reason that DBSK’s case status will make the whole SM family couldn’t unite in the concert.

However, on August 14th when SM released SMTOWN Summer album ‘09, they promoted the song by stressing it as ‘a song which shows friendship among the young men‘ which shows a whole contradictory.”

DBSK fancafe demanded not only full refund of their tickets, but also 10% admission fee as compensation and official apology from SM Entertainment.

The name vik was coined by junsu.. from “visual shock”
About why i decided to raise him.. at that time, i saw a dog on a television show of the same breed as vik and just really really wanted to raise one. Later when i went with a trainer to pick out a dog, he was the very first dog i saw when i entered the door.

At that time, vik was only two months old. he was soooooo cute! At that moment to me, it didn’t matter what his personality was like, his looks more than made up for it then.Because my dad is the one raising him, you look at him now, he’s absolutely choongchoongdu style- doesn’t care about anything at all. If the weather is good, he’ll just lie there like this doing nothing. he doesn’t bark, doesn’t play around. If he fights with the other member’s dogs, he’ll definitely lose… he’s very gentle.

There’s one other thing about his personality.. helping him to bathe is VERY difficult. Bathing him yesterday took a total of 5 hours! our staff… XPIn the old house, we didn’t wash him often and there really wasn’t a need to. My dad likes to use those huge tubs for bathing children to wash him but vic likes to swim around. He also really likes it when we use the shower head.

There have been times when i’ve thought about it and regretted.. why did i have to choose to raise such a huge dog? especially since my parents are the ones having a hard time raising him since he’s so big… If he was very active or knew how to act cute and play around, at least kids would like him. but look at him! look~ he doesn’t even show signs of happiness when he sees his master. he doesn’t like to run but likes to stroll verrrryyy slowly. he’s only one!!Out of a year, we usually can spend only about a month or so together. When he was still really young i would bring him around everywhere, feed him… i always believed he should remember me! I didn’t expect it to end up being totally different… he ignores me when i call him, he doesn’t even respond to his name, he’ll only listen to you when you’re calling him for meals.

Another unique thing about Vick is that he totally ignores you.. when i bring him for walks in the park he won’t stroll along nicely, he’ll go searching in strange places and i have no idea what he’s searching for!

For meals, he likes meat alot. But my dad doesn’t allow him to eat too much meat because he’s afraid Vic will fail sick. Always eating meat will also make his body smell which is why we don’t let him eat much. but this kid… he seems to live for eating.. pork, chicken. he loves them all.How do we show affection to each other? vik ahh.. give me your hand~ (vic puts his paw on jae’s hand) just like this! i’m the only one vic is willing to shake hands with~

Another thing about vic is if you call him the third time he definitely won’t listen. If you ask him for his hand, his leg, he’ll always listen and shake hands with me. But always only twice. he’ll definitely ignore you on the third call.With my family.. yeah. My mum really liked him from the start. But now it’s always my dad who looks after him. Among my sisters, vik is only close to two or three of them and they play very well together. the other sisters are all very scared of him because he’s too big…Now we still have alot of overseas activities, i’ll have to sent him back to choongchoongdu..I hope everyone will continue to love our vik! and continue to give me your support, thank you! vik ah~~ let’s go^^

Even though three of the five members of TVXQ are in a dispute with their agency, the group's Japanese activities will continue as planned.

TVXQ's Japanese agency Avex stated on their official website on the 6th that, "We will continue to fully support TVXQ's activities in Japan. Please give TVXQ attention and love."

On the statement, Avex also added that, "Both sides have told us they do not want TVXQ to disband. We took this statement as saying that SM Entertainment and the three members wish to continue with their planned activities in Japan."

TVXQ is currently participating in 'A-Nation 09', a music festival held by the singers in Avex Entertainment and the group already performed in Kumamoto on the 1st and Ehime on the 8th. All five of them will be performing on stage at Tokyo (22~23rd) and Osaka (29~30th).

After that event, YoungWoong Jaejoong and Micky Yoochun will be releasing a single on the 30th of next month. The title song of this single is 'COLORS Melody and Harmony' that they first showcased at their Tokyo Dome performances on the 4th and 5th. They will also be participating in the music event 'BOY POP FACTORY 09' on the 20th to sing their duet song.

Also, on the 7th of September, they are scheduled to appear on the NHK Hall stage in Tokyo, Shibuya for NHK's most notable music program 'Music Japan'. And after that, they are set to collaborate with popular group M-flo for their 10th anniversary album which will be release on September 16th. They will be singing a duet piece, 'Been So Long'.

'COLORS Melody and Harmony' which YoungWoong Jaejoong and Micky Yoochun wrote the lyrics for and arranged, was chosen to be the image song for the 35th anniversary of Hello Kitty and will be used as background music in all Sanrio shops across Japan starting from September.

Avex will also begin selling the '2010 TVXQ Official Calendar' to TVXQ's Official Japanese Fanclub Bigeast on the 19th. However, it is uncertain whether there will be any activities after September in which all five members will all be attending.

2009 Summer SM Town Album To Be Released on the 14th

The list of SM Entertainment artists who will participate in new album Summer SMTOWN ‘09 is released.

On August 11th, representative from SM Entertainment said, “On December August 14th, Summer SMTOWN ‘09 will be released.”

“Two years later, in 2007 we also released the album for whole Asia. The participating groups for upcoming new album are TVXQ, Super Junior, and SHINee. There will be 4 songs in the album which features the powerful summer atmosphere, including the title song “Seaside” where you can feel the warm friendship between these young men.”

In addition, for song “12: 34″ which features TVXQ, Choikang Changmin is in charge for the lyrics, while Super Junior will sing a song from their 2nd Asia Tour “Carnival” that is highly anticipated by the fans, and SHINee is coming up with a dance song titled “SCAR”. Meanwhile the title song “Seaside” is planned to be released for the first time through on line site.

SM: We gave DBSK 40% of the profit

SM Entertainment revealed recently, “We split profits with group Dong Bang Shin Ki at the ratio of 4:6.”

Revealed on MC programme “Current Affairs Magazine 2580′ aired on 9th August, Dong Bang Shin Ki has brought in a recorded 4.98 billion KRW. Of these, SM has invested 2.24 KRW. And the rest was split between the group and SM at 4:6.”

SM said, “Of the benefits, Dong Bang Shin Ki gets 4 proportions and SM gets 6 proportions. Of the 2.74 KRW, Dong Bang Shin Ki gets 1.10 KRW and SM gets 1.64KRW.”

It was also revealed that for overseas promotions, Dong Bang Shin Ki gets 7 and SM gets 3 proportions.Also for overseas event, CF revenues, they are split at 7:3.

But according to the 3 members of Dong Bang Shin Ki, “The splitting of profits is not transparent. We cannot trust them.”

And also about their 13-year contract, SM said, “We also secured the time when the group went overseas to promote. In Korea 3~4 years, in Japan 3~4 year, in China, it was 3~4 years.”

And about this, the 3 members’ lawyer said, “This is a contract which will make this idol stars work their live. Also for album sales, they only receive no more than 0.4~1% for each member.”

After the ‘SM TWON LIVE ‘09′ was postponed indefinitely by SM Entertainment who said the reason was the lawsuit between the agency and TVXQ’s three members, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, the fans’ criticisim has been flooding in.

SM released an official statement on the 7th of Augus stating that, “The ‘SM TOWN LIVE ‘09′ that was scheduled to be held on August 16th at the Seoul Jamsil Olympic Stadium has been postponed indefinitely.”

SM also stated that all ticket holders would be receiving a full refund but the fans’ rage did not subside easily. On TVXQ’s Hompage, posts of disappointment came from not only TVXQ fans, but from fans of other singers who were to be performing in the SM TOWN concert.

TVXQ fans stated, “We put a lot of effort and money into making events, and now they’ve become obsolete,” “How are they going to compensate for our efforts to secure tickets?” “We even rented a car to go, how are going to compensate for that?” “We’ve waited one year, and this is what we get?” They showed such strong reactions and protested to SM Entertainment. Some fans said that SM was trying to place the blame on TVXQ by saying that the concert was postponed because of the group and harshly criticized SM for what they did.

The fans of fellow SM Entertainment singers such as SHINee and Super Junior also showed their discontent and sided with and supported the fans of TVXQ

Some fans said they would visit SM to give their complaints while other said they would boycott SM goods. There has also been a suggestion for all the fans to gather and rally against SM on the 16th at the Jamsil Olympic Stadium at the time the concert was supposed to happen.

SM said, “SM TOWN LIVE ‘09 was a concert that was extremely popular with tickets being sold out as soon as they were put on sale, so we are very sorry to be giving out this unfortunate news,” and “We promise to bring a better SM TOWN LIVE concert in the future to those fans and families who wish to come to these concerts.”

Nicole, member of group KARA, who are currently busy promoting their second full length album , expressed how she felt about the news regarding Dong Bang Shin Ki (TVXQ).

While in the waiting room for KBS 2’s Music Bank where KARA had a special stage with Brown Eyed Girls, Nicole was asked by reporters about her thoughts on the on-going trouble in SM Entertainment regarding the case filed by the 3 members of TVXQ against the management.

Nicole expressed outright that she did not want the group to disband.

She says “I’m really sad about the rumors regarding the disbanding of TVXQ. As a fan that really likes TVXQ, I hope that this problem can be solved amicably. Recently having 3 of its members caught in a lawsuit with their company about retracting the exclusive rights from their contract with SM Entertainment, Dong Bang Shin Ki has promised that they will perform in Japan again, fending off rumours for disband.

It was written on Asihi newspaper on 7th August, “Dong Bang Shin Ki has fended off rumours for disband. Dong Bang Shin Ki had performed in Tokyo for the 30th 神宮 fireworks festival on 6th August.”

The news added, “They have assured worried fans about rumours to their disband. After the live performance that day, they had said, ‘Very enjoyable. We want to do this again’.”

“This is their first stage after news of danger of their disbanding, Dong Bang Shin Ki showed that those news are just rumours and are not affected by those news at all. DBSK Changed Their Numbers

It was found that TVXQ's YoungWoong Jaejoong, MIcky Yoochun and Xiah Junsu, who are currently in a dispute with their agency SM Entertainment, have all changed their phone numbers.

One person who knows TVXQ said, "I called them to give them some support because I knew they were having a hard time with this situation, but their numbers had changed," and "I think they changed their numbers because right now is a very sensitive period for them."

The dispute between the three members and their agency continues and acquaintances and close friends are all choosing their words very carefully. Xiah Junsu's father, whom Newsen met recently, said, "I feel very frustrated right now but I have nothing to tell you."

It seems that since this issue is very sensitive and complicated, any word or phrase said will probably be twisted and misunderstood.

It is not only the three members who are watching what they say. Their agency SM Entertainment is also holding back on this lawsuit. Both sides can be seen watching the issue closely and carefully preparing for what is to come.

On a side note, TVXQ restarted their activities by perfo그ing on the 6th in the Meiji Jingu Fireworks Summer Event held in Tokyo. TVXQ left for Japan a day before on the 5th. Hundreds of fans flocked to Kimpo airport to get a glimpse of them.

TVXQ are planning to release a new single in September and will be performing in the SM Town Live 09 concert on the 16th this month in Seoul Jamsil Olympic Stadium.

On the 3rd, the three members of TVXQ who filed the lawsuit, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, released their official statement that the exclusive contract they had with their agency was unlawful and they did not wish for a disbandment of the group. During the afternoon of the 3rd, SM Entertainment released a rebuttal stating that TVXQ was emphasizing too much on one aspect and that the agency had paid TVXQ 11 billion Won till now.

Tohoshinki Thank Fans At Jingu Fireworks Fest.

Korea 5 members group TVXQ on August 6th conducted a live performance in an annual event Tokyo Meiji Jingu Shrine Fireworks. Jaejoong said, “It’s a great pleasure to participate in the shrine fireworks for the first time. Also a chance to perform many songs, many thanks to you.” while Changmin added, “Please enjoy the live in TVXQ’s way.” sent a great lively atmosphere.

“TOHOSHINKI!!!” the calling broke in from silence, as the members appeared. “Thank you! This is TOHOSHINKI!” they said, in reply to the fans support. “You all come here with your friends and lovers and are having the lovely times, right? We do not have girlfriend…” they started a fascination and humorous talk. “Share The World, PURPLE LINE” were performed, started at 7 pm.

Before the performance, the group’s agency in Japan, the trinamous entertainment AVEX made a statement in the official site, “We (AVEX) will work hard to support Tohoshinki in Japan, watching the warm future of Tohoshinki.”

Today Tohoshinki was in charge as the last performer in the National Stadium. GIRL NEXT DOOR, Asia Engineer, MEGARYU, Satomi Takai performed formerly.

The 30th Jingu Shrine Fireworks this year has a total 12,000 fireworks being shot in the sky. The firework shooting from one single place, and in fact is a big event as the pride of Tokyo.

Due to lawsuit from TVXQ SM Entertainment (SM)’s SM Concert was postponed.

On August 7th, SM representative said, “SMTOWN LIVE’09 which will be held August 16 at the Seoul Jamsil Olympic Stadium will be temporarily postponed,” he said. For the sake of quality of performance, since there’s still TVXQ dispositition running against SM, the current time is not a good environtment to make decision regarding the concert, thus it need to be temporarily postponed.

TVXQ Dispels Disbandment Rumors

The members of TVXQ, who have been in a dispute with SM because of their contract, dispelled any rumors of disbandment by promising to return to the Japanese stage next year.

On the 7th, Asahi newspaper reported, "TVXQ dispelled any rumors of disbandment by singing their hearts out on stage that calmed the fans' worries," and "Right after the live performance, TVXQ said, 'We had so much fun. We want to do it again."

Asahi newspaper also said, "This was their first performance after the disbandment rumors. TVXQ gets VIP treatment in Japan

TVXQ participated in the Meiji Jingu Fireworks Summer Event held in Tokyo, Shinjuku. The staff working at the event covered the passage that lead the members to the stage with black material so the members would not feel disorientated by the fireworks.

According to Japan's Daily Sports newspaper, "So that the five members, including Junsu(23), Jejung(23), and Yuchun(23) who filed a lawsuit against SM, would not feel disoriented or panicked by everything, the staff at the event covered the passage leading to the stage with black material and gave the members 'VIP Treatment'." It also said, "After all five of them said, 'Hello, We are TVXQ!' in unison, they sang seven songs straight without wavering."

Japan's Mainichi newspaper said, "According to TVXQ's Japanese agency Avex, all five of them will be participating in the 'a-nation 09' performances on the 22~23 in Tokyo and the 29~30th in Osaka as planned."

Misunderstanding due to their mysterious close acquaintances

DBSK members are angered by false truths being reported and the influence this has caused.
On the 6th, the lawyer representing the three members stated, "there have a rampage of statements given by people who were reported to be close acquaintances. The speculative and slanderous reports by them are distorting this situation. They have appeared and discussed issues such as motives for the lawsuit but they all possess some misunderstandings about the issue. Acquaintances are only acquaintances, they are not DBSK members. There is no troubles between the members. Members are not happy about what they are hearing.

Through their lawyer, the three members recently forbid all their close acquaintances from talking about this issue. Not only did all members change their contact information, they have expressed their intentions not to publicly speak about their official stance for a while. This can be seen as decisions due to the troubles that slips of tongues has caused.

The reason that DBSK members have forbid their acquaintances from talking is due to the start of rumors about troubles between the members. They have expressed multiple times that there are no troubles. However, a close friend of the members revealed that there was some trouble between the members who filed for lawsuit and the 2 members who did not. There was also rumors that after the Thailand concert, the members hunt out separately and that they acted separately even in Korea. These rumors were found to be groundless. DBSK members left to Japan on the 6th and as always, arrived to the airport in one van.

The same thing can be said for rumors that the 3 members filed for lawsuit without consulting the other two members. This time, a 'close acquaintance' of the two members showed up stating that the makeup company was the reason for this lawsuit and that the 2 remaining members remained silent in order to avoid disbandment. This acquaintance reported that if the situation worsened, the two members would file for compensations to SM and the three members.

These rumors cannot be confirmed, and moreover can make the situation worse. The lawyer and SM both revealed that these rumors are false. A staff reported, "the situation is very sensitive. The situation changes by the minute. The act by the members to forbid their close friends from talking was unavoidable."

TVXQ's three members, YoungWoong Jaejoong, Xiah Junsu, and Micky Yoochun, who have filed for an Exclusive Contract Validity Suspension and Provisional Disposition Request against SM Entertainment, have decided not to release any more official statements.

SM has hired a lawyer to tackle the three members' lawsuit and the first hearing date has been set for the 21st. On the 5th, Sejong, who is representing the three members, told people who have been asking about the three members' feelings about the situation and the two other members' relationship to this trial that, "Since the hearing date has been confirmed, we believe that the right way to handle this situation is to deal with issues only in court."

On a side note, TVXQ will be attending to their regular schedule regardless of the trial. They will be performing at the '2009 Jingoo Fireworks Contest' held on the 6th in Tokyo and will be participating in the 'SM Twon Live 09' concert held on the 16th in the Seoul Jamsil Olympic Stadium. Popular South Korean group TVXQ's rumors to break up has been taken up on a large scale all throughout Asia including Japan and China. It originated from the treatment problem caused by their office. The members who sued the office declare that they do not wish for dissolution

TVXQ’s U-Know Yunho has been attracting attention by continuing on with filming for his drama even though the future of his group might be at stake.

U-Know Yunho was cast for his acting debut on MBC’s new Wednesday-Thursday drama ‘Heading to the Ground’ (Director Park Sungsoo, Writers Kim Solji, Kim Yehji) and began filming on the 28th last month.

During the past week, TVXQ’s members YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu filed for a Exclusive Contract Validity Suspension and Provisional Disposition Request against SM Entertainment and the rift between the two sides have gotten deeper as time passes. However, this has not stopped U-Know Yunho from taking his lead role seriously and contunuing with the filming for the drama.

One representative said on the 5th that, “U-Know Yunho is working extremely hard on set as he usually does even though he is surrounded by the chaos that is happening right now,” and “We filmed on the 4th at Kyunggi-do Kimpo as well.” They are busy filming throughout the night going back and forth from Seoul and its borders for the first few scenes. dbsk to attend fireworks festival in japan

All five DBSK members will be participating in the ‘30th Annual Jingumae Fireworks Festival’ hosted by Nikkan Sports newspaper in Tokyo on the 6th. All members of DBSK will perform on stage at the National Stadium in Tokyo as planned. It seems as though their appearance at the event is official because earlier today, Nikkan Sports posted a bulletin on their hompage, announcing that DBSK will be present at the event.

So, it seems as though not all of DBSK’s schedules have been cancelled or postponed, as previously announced. Apparently Yun-ho and Chang-min attended the ‘A-Nation 09′ event in Japan on the 1st and happily performed together, without showing any signs of tension. Also, the word around town is that DBSK will also attend the ‘SM Town Live 09′ concert in Seoul on the 16th.

In the recording of MBC “Quiz to Change The World” which will broadcast on August 8th, at the solo scene where Lee Min Woo took “sudden performance” corner, without noticement he’s transferred in a phone call where Jaejoong made his surprise appearance being someone Min Woo found across the line.

Min Woo who happened to call Jaejoong who was currently in Japan was surprised, yet they had a good time through the phonecall. In meantime, this telerecording was made before the lawsuit against SM submitted.

The fact that U-Know Yunho and Choikang Changmin do not follow their 3 members to apply injunction application against SM Entertainment to suspend the exclusive contract effect has been drawing a lot of attention.

In April, it was judged that the contract period can be a clause to void contract because it severely restricts an artist's moral influence as well as economic freedom. Secretary General Kim added that if a group as popular as DBSK are in such situations, the reality for nameless celebrities and trainees must be investigated. Further, he stated that this situation will have influence on mainstream music industry for the first half of the year and this opportunity should be used to examine the way the music industry functions.

In order to avoid relapse of the situation, he stated as a solution, "first of all, the ideal contract released by Fair Trade Commissions must be upheld by the music industry. The league of singers is considering plans which includes a center to aid for accusing companies for harm done or even developing a specific subordinate contract which will be attached to the official contract.
